The MEC for Eastern Cape Cooperative Governance and Traditional Affairs Hon. Xolile Nqatha has welcomed the out of court settlement endorsed by the Port Elizabeth High Court today (19 January 2020). The court has declared that:

  • The election of executive mayor was inconsistent with the constitution of the Republic of South Africa and is invalid. 
  • The election of acting speaker was inconsistent with the constitution of the Republic of South Africa and is invalid.   
  • The speaker of the Nelson Mandela Bay Metro has been ordered to convene a council meeting within seven days to elect the new executive mayor. 
  • The DA agreed to the out of court settlement

The department will closely monitor if the Nelson Mandela Bay Metro will implement this order.

“We welcome the court order as it is in line with our desire to restore rule law and good governance in the Nelson Mandela Bay metro. We urge all parties, individuals and councilors to ensure that this noble goal is achieved, ” MEC Nqatha.
